LOGAN — A judge has refused to release a 28-year-old Nibley man who pleaded guilty to stalking and attempting to run over a woman with his vehicle.
Dennis K. Seamons appeared in 1st District Court Wednesday morning, waiving his right to a preliminary hearing and accepting a plea deal with prosecutors. Under conditions of the agreement, he pleaded guilty to two charges of stalking, a third-degree felony and attempted aggravated assault, a class A misdemeanor.
State attorney Barbara Lachmar told the court, Seamons had repeatedly been trying to contact the female victim, a former acquaintance. He had reportedly threatened her multiple times, violating a stalking injunction against him. In one instance, he also tried to hit the woman with his truck while she was walking alongside a road.
Seamons will be sentenced May 5 and could face up to five years in prison.
Defense attorney, Shannon Demler asked the court to release Seamons until he is sentenced, so he could continue working. He proposed having him wear an ankle monitor to allow probation officers to track him.
Lachmar objected telling the court how Seamons had continually harassed the victim, even contacting her place of employment. She also said deputies believed he was hiding out, before being arrested earlier this month.
Judge Brian Cannell agreed with Lachmar and ordered Seamons to remain in jail. He also ordered Adult Probation and Parole to conduct a pre-sentence report. The report will look at his criminal history, the relationship he had with the victim and propose a suggested sentence.
