LOGAN — A 40-year-old Logan man has been sentenced to at least 10-years in prison for sexually abusing a child a year-and-a-half ago.

Cody Smith appeared in 1st District Court Thursday afternoon after pleading guilty in January to two charges of aggravated sex abuse of a child, both first-degree felonies.

Court records show Judge Brian Cannell sentenced Smith to serve 10-years-to-life in prison for each charge, with the sentences running concurrently. He also ordered him to pay $1800 in restitution for the costs of mental health counseling for the victim.

Smith was originally arrested in March 2013, accused of encouraging a teenage girl and her boyfriend to engage in sex while in his home. The girl also said Smith fondled her on multiple occasions.

Prosecutors originally filed 14 charges against Smith including nine counts of rape of a child and object rape, all first-degree felonies, forcible sex abuse and criminal solicitation, both second-degree felonies, and three counts of unlawful sexual activity with a minor, all class B misdemeanors.

During his trial in January, Smith accepted a plea deal, pleading no contest to both counts, where he neither admitted guilt nor disputed the charges.
