LOGAN — A father and daughter have been arrested for allegedly sexually assaulting a teenage couple on New Year’s Eve, according to law enforcement. Billy Wayne Smith, 47, and Autumn Christina Eley, 21, are both behind bars following a seven month investigation by the Logan City Police Department.
According to the affidavits of probable cause, police responded to an alleged sexual assault involving a 15-year-old female and 16-year-old male on December 31, 2024. The girl explained how she and her boyfriend had gone to her friend’s residence, a studio apartment shared by Eley and Smith.
The alleged victims claimed that while they were at the apartment, Eley and Smith provided them alcohol. The teenagers then witnessed the father and daughter go into the bathroom together to supposedly smoke meth. Afterwards, the four reportedly walked to a nearby convenience store to purchase sodas, cigarettes and more alcohol.
The alleged victims told police, Smith approached each of them separately, asking if they would participate in sexual activities with him and his daughter. He also talked about other sexual things during the walk, court documents detailed.
Once the four were back at the apartment, Smith allegedly took the teenage girl into the bathroom, where he molested and sexually assaulted her. At the same time, the teenage boy reported Eley began kissing and sexually abusing him.
The assaults reportedly continued until the teenage girl called to her boyfriend to come into the bathroom. The couple left the apartment soon after and called police, according to the arrest affidavits.
Officers report the teenage girl had a sexual assault examination done to collect any DNA samples. She and the teenage boy were later interviewed at the Cache County Children’s Justice Center.
As the investigation continued, police questioned Smith and Eley at the police department. Both denied sexually assaulting the teens, and claimed the drinks they gave the alleged victims were apple juice and cinnamon.
On July 8, police received the results from the sexual assault examination. It showed, DNA collected from the teenage girl matched Smith’s. Officers immediately attempted to locate the suspects, learning that Smith was reportedly out of town for work and Ely was living with a friend at a hotel.
Eley was arrested July 18, and booked into the Cache County Jail, where she remains held without bail. She has been charged with one count of forcible sodomy, a first-degree felony.
According to court records, Eley is scheduled to appear again in court Aug. 6.
Smith turned himself in at the police department July 28, and was also booked into the Cache County Jail. He is being held on suspicion of committing forcible sodomy and object rape, and will likely be arraigned on formal charges this week.
According to court records, Smith was convicted of sexual abuse, a first-degree felony, while living in Kentucky, in 2009. He remains on the sex-offender registry and is prohibited from being around children.
Individuals arrested and charged in complaints are presumed innocent unless or until proven guilty beyond a reasonable doubt in court.
