LOGAN, Utah — A 32-year-old Logan man with a lengthy criminal history has been sentenced to jail and probation for a shooting 21 months ago. The incident occurred Oct. 16, 2024, at about 11 p.m. near 330 W. 100 North.
Rocky Escareno Rivera was sentenced July 15 in Logan’s First District Court. He previously pleaded guilty to aggravated assault, felony discharge of a firearm and possession with intent to distribute a controlled substance — all third-degree felonies.
According to prosecutors, Logan police officers were called to a Logan residence Oct. 16, 2024. The complainant stated there were two people shooting at each other and at least two gunshots were heard.
Police arrived and contacted several people at the home, including Rivera. He had two stab wounds to his right shoulder and was transported to Logan Regional Hospital for treatment.
Officers also located a spent pistol cartridge and a black knife on the sidewalk and grassy area in front of the residence, charging documents stated.
A man told police he had driven his female cousin to Rivera’s home to pick up her child. When they arrived, the defendant reportedly walked around to the driver’s side of the car and began stabbing the man in the shoulder. The assault continued until the driver was able to put the vehicle in drive and get away.
A short time later, the man and woman returned to Rivera’s home to retrieve the child again. This time, the defendant came out of the residence with a pistol and shot into the ground. He then pointed the weapon at the man and said he was going to kill him, firing the gun a second time. The fight continued, with the victim stabbing Rivera with a black knife he had in his pocket, the charges detailed.
Police reported the victim had a deep cut on his left hand, consistent with a defensive wound. He also had a thick black jacket on that had several puncture holes on the left sleeve, as well as a stab wound on his left arm.
When police attempted to question Rivera, he immediately requested an attorney.
Officers obtained several warrants to search the residence. They found a large amount of blood and a holster inside the home. Video footage from a doorbell camera also showed the disputes and shooting.
Police noted Rivera has previous convictions for associating with other gang members.
During the sentencing Wednesday, Rivera said he was sorry to the people he had harmed. He expressed hope to be a better parent for his children.
Judge Angela Fonnesbeck noted that Rivera had already served about 600 days in the Cache County Jail, double the recommendation under Utah law. She sentenced him to 587 days, with credit for time already served. She also noted the defendant’s lengthy criminal history and gang affiliation, ordering him to be placed on 36 months of probation.
“You have children who need you,” Judge Fonnesbeck told Rivera. “You have the opportunity to prove to society that you aren’t a threat anymore.”
