LOGAN — A 41-year-old Logan man has been arrested for allegedly raping a 14-year-old Smithfield girl, according to law enforcement. Francesco Antonio Gutierrez-Moreira was booked Sunday into the Cache County Jail.

According to an arrest affidavit, Smithfield City Police officers received a call from the alleged victim on June 13. She claimed Gutierrez-Moreira, a family friend, had travelled to her home early on the morning of June 8 and raped her.

The girl explained how she had called her friend to come over but later realized she had dialed the wrong number, accidentally calling Gutierrez-Moreira. She also provided DNA evidence to police.

On June 23, police questioned Gutierrez-Moreira. He acknowledged to getting a phone call from the alleged victim but wouldn’t admit to raping her, the probable cause statement detailed.

Police have asked a judge to hold Gutierrez-Moreira without bail, claiming he is a danger to the community and other children. They report he doesn’t have family in the United States and would be a flight risk.  

Monday, prosecutors filed a criminal case against Gutierrez-Moreira. They charged him with rape of a child, a first-degree felony; and sexual abuse of a child, a second-degree felony.

According to jail records, Gutierrez-Moreira is being held temporarily without bail. He could face up to life in prison, if convicted.

Individuals arrested and charged in complaints are presumed innocent unless or until proven guilty beyond a reasonable doubt in court.
