LOGAN — A 69-year-old Millville man with multiple drug arrests is facing a felony weapon charge after probation officers discovered an unloaded sawed-off shotgun stashed beside his bed during a compliance check, according to court records.
Gary Lee Fackrell was charged in 1st District Court in Logan with one count of being a restricted person in possession of a dangerous weapon, a second-degree felony.
According to a probable cause statement, agents with Cache County Probation conducted a home visit on Oct. 13 at Fackrell’s. At the time of the inspection, Fackrell was serving court-ordered probation under county supervision following a previous conviction for possession of a controlled substance.
While searching Fackrell’s bedroom, an agent discovered a black 12-gauge sawed-off shotgun hidden between the bed and the wall, resting near his pillow. The weapon was unloaded.
Probation agents immediately contacted the Cache County Sheriff’s Office, and a responding deputy took Fackrell into custody and transported him to the Cache County Jail.
At the jail, Fackrell was advised of his Miranda rights and agreed to speak with deputies. When asked why the shotgun was in his room, Fackrell said he did not know. He told investigators that the firearm is often kept in his brother’s room.
Fackrell acknowledged that his supervising probation agent had previously informed him that he is legally prohibited from possessing any firearms while on probation.
According to court records, Fackrell is also facing a third-degree felony charge of possession of a controlled substance. He is scheduled to make an initial appearance on both charges Nov. 2.
Individuals arrested and charged in complaints are presumed innocent unless or until proven guilty beyond a reasonable doubt in court.
