LOGAN — An 18-year-old Logan man already facing drug distribution charges is now being investigated for having sex with a teenage girl and recording it on his cellphone, according to law enforcement. Damian Jay Aparicio is being held in the Cache County Jail facing several criminal cases.
According to an affidavit of probable cause, Aparicio was arrested by the Cache Rich Drug Task Force, who allegedly found drugs, ammunition and firearm accessories inside the home. The suspect also reportedly has a lengthy criminal history and documented gang affiliations.
Investigators report that while searching Aparicio’s phone, they located a hidden folder that contained videos and photos of him having sex with the teenage girl. Investigators were able to identify the victim and determine she is 17-years-old.
Law enforcement questioned Aparicio about the child sex abuse material on his phone. He claimed that he was 17-years-old when the videos and photos were taken. However, agents noted that according to Utah law, it is still illegal to produce CSAM at 17 years of age.
According to court records, Aparicio is facing three counts of aggravated sexual exploitation of a minor, a first-degree felony; possession with the intent to distribute a controlled substance, a third-degree felony; and, possession of drug paraphernalia, a class B misdemeanor.
Aparicio is currently being held without bail and is scheduled to appear again in court Monday afternoon. He could face up to life in prison, if convicted.
Individuals arrested and charged in complaints are presumed innocent unless or until proven guilty beyond a reasonable doubt in court.
