LOGAN — A 42-year-old Logan man has been arrested for allegedly breaking into a neighbor’s apartment to try and view them in the bathroom, according to law enforcement. James Todd Atchley was booked Tuesday into the Cache County Jail.

According to an affidavit of probable cause, Logan City Police officers were called June 17 to an apartment complex near 700 S. 300 West. The alleged victim claimed they returned home from work at around 2:30 p.m. and found their downstairs neighbor in their bathroom.

They said Atchley had reportedly entered the residence through a back door that was unlocked. He had been caught trying to install a camera behind the light switch cover that faces both the shower and toilet inside the apartment’s bathroom.

The alleged victim told police, they hadn’t gotten a good look at the device, except for noticing it was black in color.

Atchley reportedly said, he was trying to see the alleged victim naked. He quickly replaced the light switch cover and left after being discovered.

Police made contact with Atchley at his apartment. He refused to answer any questions.

According to court records, Atchley was charged in Logan’s 1st District Court with burglary of a dwelling, a second-degree felony; and voyeurism, a class B misdemeanor.

Atchley was scheduled to be arraigned before a judge Wednesday afternoon but posted bail before the hearing. He could face up to 15 years in prison, if convicted.

Individuals arrested and charged in complaints are presumed innocent unless or until proven guilty beyond a reasonable doubt in court.
