LOGAN — A 47-year-old Logan man previously charged with sexual battery and public urination has been found incompetent to stand trial. Eyasu Birhane Dirar has been in the Cache County Jail for the past 11 months.
According to court records, Dirar appeared June 2 in Logan’s 1st District Court. He was previously charged with with three counts of lewdness involving a child, two counts of sexual battery and two counts of criminal trespass, all class A misdemeanors; interference with an arresting officer, a class B misdemeanor; intoxication and consuming liquor in a public place, both class C misdemeanors; along with infractions for public urination and disorderly conduct. The charges stemmed from three separate incidents in August 2023, May and July 2024.
On May 29, 2024, Logan City Police officers received a call claiming Dirar was seen urinating into the Little Logan River. He reportedly had long hair, and was wearing a gray sweater and black pants.
Police arrived on scene and located the suspect, later identified as Dirar. He reportedly did not speak English and had a heavy odor of alcohol coming from his person.
The three juveniles described how Dirar allegedly exposed himself to them while urinating in the small creek. He had fled the area on foot, walking west on 400 South, before being located by police.
During Monday’s court hearing, a representative from the Utah State Hospital said they had evaluated Dirar and determined he was not competent to be able to defend himself against the charges. Doctors had also reported there was little chance that competency could be restored through treatment.
Following the report on the evaluations, Judge Angela Fonnesbeck dismissed the three pending cases.
According to jail records, Dirar has been released from jail.
