GARDEN CITY, Utah — A 53-year-old man faces criminal charges after allegedly shooting a BB gun at juveniles and striking two of them at a local campground, according to court documents.
Timothy Glade Holdaway was arrested Saturday night by the Rich County Sheriff’s Office following the incident at the Trail Side KOA Campground in Garden City. Deputies responded to reports of an adult male firing a BB gun from an employee housing area located west of the campground. Upon arrival, responding officers found physical evidence that two juvenile males had been struck by BBs and obtained statements from multiple witnesses.
According to an affidavit of probable cause, witnesses described the shooter as an older man with gray hair, a hat, a gray shirt, and a goatee. Deputies identified Holdaway as a suspect because he resided in the employee housing where the shots originated and matched the physical description. Additionally, a neighbor told deputies that Holdaway owned a BB gun and regularly used it to shoot at trash cans and squirrels.
Investigators subsequently prepared a six-person photographic lineup and presented it to witnesses. One juvenile witness positively and confidently identified Holdaway as the person who fired the weapon, noting the shooter had facial hair at the time of the incident. Although Holdaway lacked facial hair when interviewed by law enforcement, Wilcox noted that sufficient time had elapsed for the suspect to have removed it.
Holdaway denied any involvement in the incident and denied owning a BB gun. He was booked into the Rich County Jail on suspicion of committing two counts of misdemeanor assault.
Individuals arrested and charged in complaints are presumed innocent unless or until proven guilty beyond a reasonable doubt in court.
