LOGAN — A 39-year-old Logan man is headed to prison after a judge said his drinking made him a threat to the community. Mitch Hamilton White has been in the Cache County Jail since his most recent DUI arrest Oct. 7.
White was sentenced Monday, Dec. 4, in Logan’s 1st District Court. He previously accepted a plea deal, pleading guilty to one count of driving under the influence, a third-degree felony.
According to prosecutors, an off-duty Cache County Sheriff’s deputy had spotted White riding a motorized scooter along 200 North in Logan on Oct. 7. As the deputy was following, the bike ran a stop sign, a red light and was weaving into oncoming traffic.
After initiating a traffic stop, the deputy reported White had an odor of alcohol coming from his breath. He failed a field sobriety test and later provided a breath sample, showing a breath alcohol content of .161.
Court records show, White has had multiple convictions for driving under the influence, intoxication, drug possession and other crimes. He was on probation at the time of the latest arrest. His drivers license had also been revoked and the scooter was not registered or insured.
During Monday’s sentencing, Judge Spencer Walsh said White’s drinking habit had made him a danger to the community. He sentenced the defendant to between zero-to-five years in the Utah State Correctional Facility.
Judge Walsh said he would recommend White be given credit for time already served but it will be up to the Utah Board of Pardons and Parole to determine when he is released.
