LOGAN — A 50-year-old Logan man was sentenced to jail and probation for hitting a man with his SUV and fleeing the scene last fall. Mark Allen Egbert has been in the Cache County Jail since being arrested Sept. 19.
Egbert was sentenced Monday, Nov. 27, in Logan’s 1st District Court. He previously had accepted a plea deal, pleading “no contest” to aggravated assault, amended to a third-degree felony. The plea meant he conceded the charge alleged without admitting guilt or offering a defense.
According to an arrest affidavit, Logan City Police officers were called to an auto-pedestrian crash Aug. 19. They found the victim in the front yard, with minor injuries.
Witnesses stated that they saw a white Chevy Tahoe driving recklessly down the road. The victim ran out to confront the driver, later identified as Egbert, who was seen swerving to hit the man and then speeding away.
Police were able to get a license plate number of the SUV and later arrest Egbert. They also learned he was on probation at the time and driving on a suspended license.
During Monday’s sentencing, Egbert blamed his behavior on mental health and anxiety issues. He said that he was beginning treatment for his alcohol addictions.
Judge Angela Fonnesbeck sentenced Egbert to 70 days in jail and 36 months probation, but gave him credit for the 70 days already served. She also prohibited him from contacting the victim.
Judge Fonnesbeck told Egbert, it was past time to make changes in his life. She noted his lengthy criminal history and warned that she would sentence him to prison if he was in court again.
According to court records, Egbert was convicted of drunk driving in 2020. He was later sentenced to serve one year in jail followed by three years probation. In 2017, the defendant was arrested for assaulting a man and leaving him seriously injured with a fractured back. He also assaulted the victim’s wife when she tried to intervene.
