LOGAN — A 37-year-old Logan man was arrested on suspicion of assaulting a woman during a domestic dispute and then trying to drive away drunk. Michael C. Garza was booked early Wednesday morning into the Cache County Jail.

Garza was arraigned in 1st District Court Thursday afternoon, appearing by video from jail. He was charged with aggravated assault and four counts of domestic violence in the presence of a child, all third-degree felonies, and two alcohol related misdemeanors.

Cache County Chief Deputy Attorney Spencer Walsh said Garza was reportedly fighting with the alleged victim New Year’s Eve night. He grabbed the woman around the neck, attempting to suffocate her. The fight took place in front of the woman’s children.

Police officers arrested Garza later after he tried to drive away from the home. He was found to have a blood alcohol level above the legal limit.

Walsh explained to the court that Garza had a lengthy criminal history and previously severed a prison sentence for having sex with an underage girl. He asked the court to hold suspect in jail without bail.

Judge Thomas Willmore agreed to refuse to grant Garza bail. He ordered the suspect to have no contact with the victim and appear again in court January 6.
