LOGAN — A 28-year-old Logan man is facing criminal charges after being arrested for allegedly driving under the influence twice on the same day.

According to jail records, Leon Leovany Perez was arrested Monday morning after a Utah Highway Patrol trooper spotted him driving erratically. He was booked into jail but later released.

About 12 hours later, several motorists called 911, claiming a black Dodge Charger could not maintain its lane of travel and had nearly caused several accidents. Troopers located the vehicle in Hyrum and initiated a traffic stop.

The driver, later identified as Perez, had an “overwhelming odor of alcohol coming from his person,” according to an arrest affidavit. His eyes were bloodshot and glassy. He told troopers that he had been drinking some alcohol earlier.

Perez later provided a breath sample which indicated a BAC of .291 in his system. He was booked into jail again early Tuesday morning.

Perez was arraigned Friday morning in 1st District Court. He was charged with driving under the influence, a third-degree felony; and three other misdemeanors.

Cache County Deputy Attorney Andrew Crane asked for Perez to be held in jail without bail, calling him a danger to the community. He noted that the suspect had previous DUI convictions in 2019 and 2014.

Judge Spencer Walsh expressed concern about the number of cases. He set bond at $10,000 and ordered Perez not to operate any motor vehicle, or consume alcohol and drugs, if released on bail.

Judge Walsh also ordered Perez to be fitted with an ankle monitor that would detect alcohol in his system. He said that would hopefully allow the suspect to start getting treatment, while also protecting the public.

Perez was ordered to appear again in court August 29. He could face up to five years in prison, if convicted.

Individuals arrested and charged in complaints are presumed innocent unless or until proven guilty beyond a reasonable doubt in court.
