LOGAN — A 50-year-old Logan man with a lengthy criminal history has accepted a plea deal after police reported he struck a man with his SUV and tried to flee the scene. Mark Allen Egbert has been in the Cache County Jail since being arrested Sept. 19.
According to court records, Egbert appeared Monday, Oct. 16, in Logan’s 1st District Court. He waived his rights to a preliminary hearing and fair trial, pleading “no contest” to aggravated assault, amended to a third-degree felony. The charge carries a maximum sentence of zero to five years in prison.
The plea means he concedes the charge alleged without admitting guilt or offering a defense. As part of the agreement, prosecutors dismissed two remaining charges.
According to an arrest affidavit, Logan City Police officers were called to an auto-pedestrian crash Aug. 19. They found the victim in the front yard, with minor injuries.
Witnesses stated that they saw a white Chevy Tahoe driving recklessly down the road. The victim ran out to confront the driver, later identified as Egbert, who was seen swerving to hit the man and then speeding away.
Police were able to get a license plate number of the SUV and later arrest Egbert. They also learned he was on probation at the time and driving on a suspended license.
During Monday’s hearing, Judge Angela Fonnesbeck ordered Egbert to remain in jail and complete a presentence report about his criminal history. She scheduled sentencing for Nov. 27.
According to court records, Egbert was convicted of drunk driving in 2020. He was later sentenced to serve one year in jail followed by three years probation. In 2017, the defendant was arrested for assaulting a man and leaving him seriously injured with a fractured back. He also assaulted the victim’s wife when she tried to intervene.
