LOGAN – Officials of the Logan Environmental Department are attempting to clarify new landfill load regulations under recent changes to state codes for city residents.
“Drivers taking loads to a permitted landfill or transfer station must ensure their loads are securely covered,” according to Utah Code 72-7-410.
The law specifies that landfill loads must be completely enclosed by a solid barrier to prevent debris from blowing, spilling or falling while in transit from their point of origin to disposal.
The penalty for bringing uncovered loads to the Logan Landfill will be a minimum $10 fine, according to city officials.
Local officials define a solid barrier as any tarp, mesh or netting with openings no larger than 1/4 inch; a manufacturer designed/supplied load cover that is functioning; and/or an adequately secured heavy flat object that covers the entire load, such as a mattress or plywood.
They explain that every load must be mostly covered with a solid barrier where the combination of tarps, straps and trailer/bed sides contain the load from blowing, spilling or falling from the vehicle.
The $10 fine for an uncovered load will be accessed upon entry to the Logan Landfill for loads that have items falling into the road; items that are stacked above the sides of the trailer or bed of pick-ups; or for items placed on top of straps or a tarp.
For example, they say, a pile of branches held with only a few straps would be accessed the $10 fine.
