Now, it’s up to the Justice Department to file an appeal.

The Centers for Disease Control and Prevention said Wednesday it wants the administration to fight for its indoor travel mask mandate, asking the Justice Department to appeal a ruling by a Florida judge that had called the order unlawful.

“It is CDC’s continuing assessment that at this time an order requiring masking in the indoor transportation corridor remains necessary for the public health,” the CDC wrote in a statement.

The DOJ promptly filed an appeal.

“In light of today’s assessment by the CDC that an order requiring masking in the transportation corridor remains necessary to protect the public health, the Department has filed a notice of appeal in Health Freedom Defense Fund, Inc., et al., v. Biden, et al,” said a statement from DOJ spokesperson Anthony Coley.

The Justice Department had said that it would only appeal the ruling if the CDC called for it. Prior to the judge’s ruling, the CDC had extended its mask mandate on airports and aboard planes and other modes of transportation until May 3.
