BRIGHAM CITY, Utah — The Box Elder County Attorney’s Office says a lack of communication from local police and incomplete evidence forced the release of a Tremonton couple arrested last week in connection with the 2025 death of their child.
In a public statement, prosecutors revealed the Tremonton-Garland Police Department made a “unilateral decision” to arrest Brigham and Melinda Merrell on May 6 without giving the attorney’s office an opportunity to review the evidence. While law enforcement typically involves prosecutors early in high-profile investigations to provide legal guidance, the county attorney’s office said coordination with the police department was severely limited following initial conversations about the child’s September 2025 death.
The sudden arrests automatically triggered a strict deadline under the Utah Rules of Criminal Procedure, requiring formal charges to be filed within four calendar days, or by 3 p.m. on Monday. Because prosecutors could not ethically meet that deadline, the couple was released from the Box Elder County Jail.
While police only need probable cause to make a warrantless arrest, prosecutors face a more demanding legal burden to file formal charges, requiring a reasonable probability of conviction by a unanimous jury. When the attorney’s office finally received the police case file, prosecutors said it contained numerous documents but was missing key assisting reports.
Furthermore, prosecutors stated the gravity and complexity of the investigation requires input from medical and forensic experts. The office said it could not obtain the missing information and expert opinions required to make a legally sound filing decision before the mandatory 72-hour hold expired.
The attorney’s office emphasized its commitment to a comprehensive and fair review, noting that criminal prosecutions significantly disrupt lives. The office is continuing to evaluate the evidence before making a final charging decision.
